Kerala, the southern coastal state of India, has issued a notification, which links protesting against the Citizenship Amendment Act to terrorism, trafficking and drug abuse. The notification, issued by Kerala Home Secretary Vishwas Mehta on December 30th, seeks to invoke Section 144 of the Criminal Procedure Code.

The notification, which covers the entire state, says that any violent demonstrations or use of seditious language or invasive activities in connection with the Citizenship Amendment Act (CAA) is deemed as an offence and may amount to terrorism, drug trafficking and drug abuse. It further states that anyone who displays pictures or articles about the CAA in public places or any other area considered to be dangerous, which is likely to incite violence or cause alarm among the public, will be booked for offences under the Indian Penal Code and Unlawful Activities (Prevention) Act.

The notification has elicited criticism from many quarters, including the state’s Chief Minister Pinarayi Vijayan and the opposition party. Vijayan has said that the invocation of Section 144 and linking it to terrorism and other heinous crimes is “regressive and removes the right to protest.” He further stated that the move was an attempt to suppress the voices of dissent and New Delhi was trying to turn Kerala into “police state”. Meanwhile the opposition leader, Ramesh Chennithala has questioned the move and questioned why the Indian Constitution had been rendered useless in the face of the centre’s draconian orders.

The state government has already filed a petition in the Supreme Court challenging the CAA and the notification comes close on its heels. This is seen as Kerala’s effort to protect the Constitutional Right to Freedom of Speech and Expression as Fundamental Rights.
